On Wednesday, December 11, 2019, Mr. Caffarelli presented “The Biometric Information Privacy Act after Rosenbach – A Survey of the Legal Landscape” with Alan S. Wernick of Aronberg Goldgehn.
Mr. Caffarelli & Mr. Wernick discussed the Biometric Information Privacy Act (“BIPA”) 740 ILCS 14/1 et seq., as well as the Illinois Supreme Court’s decision in Rosenbach v Six Flags Entertainment Corporation, 2019 IL 123186 (January 25, 2019). In Rosenbach, the Illinois Supreme Court held “…an individual need not allege some actual injury or adverse effect, beyond violation of his or her rights under the Act [BIPA], in order to qualify as an ‘aggrieved’ person and be entitled to seek liquidated damages and injunctive relief pursuant to the Act.”
And on Friday, December 6, 2019, Mr. Caffarelli presented “The Growth of State and Local Employment Laws: Protecting Workers or Complicating Things?” with Tracey Truesdale of Franczek PC. Mr. Caffarelli and Ms. Truesdale discussed the political polarization of employment legislation at the federal level, and how it has led to the proliferation of employment laws at the state and local level. They addressed recent developments in Illinois, Cook County and Chicago, including minimum wage, paid sick leave, business expense reimbursement and employee privacy concerns and how issues like preemption and concurrent jurisdiction play a part in asserting and defending claims.
